These terms govern your use of abovebaselinepro.com and the client portal at client.abovebaselinepro.com (the “site”), run by ABPRO_ (“we”, “us”). By using the site you agree to them. If you don’t agree, please don’t use it.
Our services
The site describes the reporting and analytics services ABPRO_ provides. The services themselves are provided under a separate written agreement with each client. Where that agreement and these terms differ, the agreement governs.
Examples and prices
Figures, charts, screenshots and the demo portfolio on the site are illustrative. They aren’t client data, and they aren’t a promise of results. Nothing on the site is financial, investment, legal or tax advice. Prices shown are current list prices; they can change, and only the prices in a signed agreement are binding.
Client portal
The portal is for authorized users of ABPRO_ clients. Keep your sign-in details to yourself, tell us right away if you think your account has been misused, and use the portal only for your organization’s business. We may suspend access to protect the service, a client or other users.
Acceptable use
When using the site, don’t:
- access, or try to access, any part of the site or portal you aren’t authorized to use
- probe, scan or test the site’s security, or interfere with how it runs
- copy, scrape or harvest content or data by automated means
- reverse engineer the site or the service, except where the law allows it regardless of this restriction
- submit false information or spam through the site’s forms
- use the site in a way that breaks the law or infringes anyone’s rights
Our intellectual property
The site, the ABPRO_ name and logo, and the site’s reporting designs, text, graphics and software belong to ABPRO_ or its licensors. You may view and print pages to evaluate our services. Any other use needs our written permission.
What you share with us
Information you submit through the site is handled under our Privacy Policy. If you share feedback or ideas with us, we may use them without any obligation to you.
Other sites and services
Links to other websites, and services the site relies on such as our sign-in provider, are run by others, and their own terms and policies apply.
Disclaimer
The site is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement, and we don’t promise the site will be uninterrupted or error-free. This doesn’t change any warranty in a client’s agreement.
Limitation of liability
To the fullest extent the law allows, ABPRO_ isn’t liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of the site. Our total liability for any claim relating to the site is limited to $100. This doesn’t limit liability under a client’s agreement, or any liability the law doesn’t allow to be limited.
Governing law
These terms are governed by the laws of the Commonwealth of Massachusetts, USA, without regard to its conflict-of-law rules. Disputes about them will be heard in the state or federal courts located in Massachusetts, and you and we consent to those courts’ jurisdiction.
Changes to these terms
We may update these terms. The new version applies from the date at the top of this page, and using the site after that date means you accept it.
